                    	     ORDINANCE NO. 9559
                  
                  
                   AN ORDINANCE TO AMEND ORDINANCE NO. 9143,
                   ENCAPTIONED AS SET FORTH HEREIN, SO AS TO AMEND
                   CONDITION NO. THREE IN SECTION TWO THEREOF
                   RELATIVE TO AN EASEMENT RESERVED BY THE CITY OF
                   CHATTANOOGA.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 9143,
         encaptioned "CLOSING AND ABANDONING PORTIONS OF BLACKFORD 
STREET
         AND WIEHL STREET SOUTHEAST OF HAMPTON STREET NORTHEAST OF EAST 
3RD
         STREET, MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN
         CONDITIONS." be and is hereby amended by deleting therefrom
         Condition No. 3 in Section 2 thereof and substituting in lieu
         thereof a new Condition No. 3 as follows:
               
                3. The execution of a sewer maintenance agreement
                   between the City of Chattanooga and the
                   Chattanooga-Hamilton County Hospital Authority
                   d/b/a Erlanger Medical Center governing the
                   responsibilities of each party with regard to
                   the appropriate maintenance of a sewer located
                   within said right-of-way.
               
               
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage as 
provided
         by law, provided that this Ordinance and Ordinance No. 9143 
shall
         not be operative until the execution of the Agreement between 
the

         City of Chattanooga and the Chattanooga-Hamilton Hospital
         Authority as required above.
